Terms and Conditions

Guarantee & Returns Policy

GUARANTEE:

Cobra Caravan Toolboxes provides 2year structural guarantee on all of our products.


It is the responsibility of the Buyer to transport the toolbox at their expense to our warehouse for warranty claim inspection.


If the warranty claim meets our conditions and deemed valid, then the toolbox will be repaired at our discretion.


Warranty will be void if the toolbox is misused, used commercially.


Buyer purchase our products from website or warehouse, buyer are deemed to accept our guarantee and trade conditions and terms.


TERMS & CONDITIONS OF TRADE


COBRA CARAVAN TOOLBOXES – (“cobra caravan Toolboxes”)



WARRANTY

Meanings

Buyer means the client specified on the Cobra Caravan Toolboxes products;


Components include a part or parts of Goods or an accessory thereto, supplied by cobra Caravan Toolboxes to the buyer.


Goods mean toolboxes or components sold to the buyer;


Repairs mean repair of the Goods or Components undertaken by Cobra Caravan Toolboxes for the buyer;



Warranty means the warranty set our below.

Warranty

Subject to the limitations and qualifications set out below, Cobra Caravan Toolboxes warrants that:


  • The goods and components are of merchantable quality ,fit for purpose, and free from defect for a period of one (1)year from the date of manufacture ; and
  • Repairs will be performed with due skill and care and fit for the purpose for a period of one (1) year from completion of repairs.


Limitations on Warranty


The warranty does not apply to any claim in respect of goods, Components or Repairs arising out of or in consequence directly or indirectly from any one or more of the following:


  1. Wear and tear
  2. Any failure to properly maintain and/or service;
  3. Improper use , maltreatment , carelessness , neglect ,including but not limited to carrying loads or use in excess of structural or legal capacity;
  4. Use that is not in accordance with any instructions given by Cobra Caravan Toolboxes;
  5. International , inadvertent or accidental damage ;
  6. Exposure to any chemical , substance , the atmosphere , weather , heat , moisture or any other element ;
  7. Inadequate or improper storage , transportation or maintenance ;
  8. Modification , conversion , alternation or adjustment made without written authorization of Cobra CaravanToolboxes or its authorized representative ;

How to Claim under this warranty

To make a claim the buyer must:


  • Contact Cobra CaravanToolboxes by telephone or email and give a description of the facts surrounding the claim and any other information required by Cobra Caravan Toolboxes within 30 days after the buyer noticed or ought reasonably have noticed the matter giving rise to the claim; and,
  • Return the goods and /or Components to Cobra Caravan Toolboxes as directed at the buyer’s own expense within 30 days of making a claim; and,
  • Provide cobra caravan Toolboxes with evidence of purchase satisfactory to Cobra Caravan Toolboxes;


If the buyer does not comply with these requirements, it may in its absolute discretion deny the claim and Cobra Caravan Toolboxes is thereupon absolved of all liability under this warranty.


Subject to Cobra Caravan Toolboxes’ obligation under the Australian Consumer Law that may not be excluded, modified or restricted, under the warranty Cobra Caravan Toolboxes’ liability is limited as follows:


  1. Repair the goods or Components; or
  2. Replace the goods or components therein; or,
  3. Refund the price paid; and,


For repairs, Cobra Caravan Toolboxes may in its absolute discretion:


  1. Repair the Goods or Components again; or,
  2. Refund the price paid for the repairs.


Cobra Caravan Toolboxes’ liability does not include or extend to the costs (including labor costs) of transportation of Goods or Components to or from Cobra Caravan Toolboxes’ premises.


Goods or Components accepted by Cobra Caravan Toolboxes for repair may at its absolute discretion be repaired with refurbished goods or components. Any goods or components replace become the property of Cobra Caravan Toolboxes

Australian Consumer Law

Under the Australian Consumer Law, in certain circumstances, the Goods and components are subject to guarantees apply in addition to other rights and remedies the Buyer may have,


The guarantees apply to a buyer where:


  1. The amount paid or payable for the goods or Components does not exceed $40,000.00 (except where the goods are not of a kind ordinarily acquired for personal , domestic household use or consumption, and the Manufacturer has limited its liability in a manner permitted by the Australian Consumer Law , in which case the Buyer’s rights are limited to that extent);
  2. The Goods are of a kind ordinarily acquired for personal. Domestic or household use or consumption; or
  3. The goods are a toolbox acquired for use principally in the transport of goods on public roads , unless the buyer acquired the goods for the purpose or re-supply or the purpose of using It up or transforming it in trade or commerce,


The buyer is entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. The buyer is also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

RETURNS:

Our returns policy is in addition to your rights under the Australian Consumer Law because we want you to be satisfied with your purchase and the performance of the tools purchased through Cobra Caravan Toolboxes . Please read the following carefully to ensure you are fully aware of your rights under this policy and our obligations to you.



Cobra Caravan Toolboxes will only accept product returns within 7 days of purchase if:


  • The product is faulty or is not of acceptable quality, or
  • The product is not fit for its intended purpose, or
  • The product does not match the sample or our description; and
  • You can present your Cobra Caravan Toolboxes tax invoice as proof of purchase.
  • You are responsible for any costs associated with returning the item to us including freight if there has .
  • The product must not be used and must remain in brand new condition.


Contact must be made either by telephone or in writing with a customer service representative before any product can be returned. Return postage is at your expense. After we receive return product, we inspect that the product remain in brand new condition. And then we refund product price ( excluding postage) to you

Shipping

We deliver products using 3rd party freight companies to your specified location. Shipping costs are determined by the size and weight of the product and the delivery location.


Delivery times are generally between 8:00 am and 5:00 pm, Monday – Friday.


If a person is not present at the specified location, the courier will take the goods to the closest depot from your address.


The goods will remain there for a maximum of 5 days. If you do not collect the goods within 5 days, they will be sent back to our warehouse and return postage costs are at your expense.


If you apply for redelivery, the postage cost are at your expense.


If we use leave safe home deliveries, you are agreeing that you cannot request the driver to ring you prior to delivery and the driver leaves the goods in a safe area if you are not at home.



If your consignment is lost or damaged after confirmation of leave safe (“Driver POD” or system “Delivered” status), we take no responsibility for that. 

Dispatch

Orders are dispatched after receiving payment. Before we send products out, we inspect products to make sure that there is no damage or no broken or no faulty with products. Shipping times are estimated at between 1 and 7 business days depending on your location. Terms and Conditions

Cobra caravan Toolboxes will only process your order once a deposit of 50% has been received. To avoid a delay to your order estimation of delivery and any misunderstanding of the order requirements, please ensure you have completed the Order Approval Form and made your deposit payment on-time.


If the customer wishes to cancel the order after paying the deposit, the deposit will only be refunded when the cancellation request is received in writing on the same day as payment has been made. In any other circumstances, the deposit is forfeited for materials/components and/or time already allocated to the order.


It is the customers responsibility to ensure the designs and dimensions meet his/her requirements. Cobra Caravan Toolboxes Toolboxes will not take any responsibility for any liability caused by the design which is singed off by the customer.

Unless specifically requested by the customer in writing, Cobra caravan Toolboxes will not be liable for protecting certain design patterns. Cobra Caravan Toolboxes will retain the rights to use any design patterns that have been produced previously.


Delivery estimation turnaround times provided by Cobra Caravan Toolboxes are estimates only and will fluctuate depending on the work load and third-party supplier/ services. If the delivery time is a crucial factor for you, please ensure this is written on your Order Approval Form and is acknowledged specifically with our sales staff.


Cobra Caravan Toolboxes will not dispatch the completed goods to a customer whom hasn’t paid in full unless prior arrangement has been agreed with management at the time of ordering or the customer has an account.


Please ensure that your contact details are correct and updated when required. It is the customers responsibility to pick up after receiving pick up notice from Cobra caravan Toolboxes within 7 days. If the customer cannot collect within this time frame, then they are to make payment in full and then arrangement for collection on a later date can be arranged within a 3-month period. Any item that hasn’t been collected during this time will be retained, sold by Cobra Caravan Toolboxes without notice and payment forfeited by the customer.


Cobra Caravan Toolboxes will collect customers private information, such as contact phone, address, full name and email address etc but will never disclose to any third party without the customers written consent.
